If nothing else is stated, it is legal for HTML to assume the ISO8859-1
charset, yes.

They should, if we want to be nicer. Although that would give us a busload
of troubles, especially when more exotic charsets are being used. I mean,
just thinking about gathering the information about all 128 characters for
all those weird charsets makes me scared...

I don't think this is any major problem as long as the charset of the mail
is used. And I believe it is.
